(629) W świetle powyższych rozważań Komisja stwierdziła, że chińskie instytucje finansowe postępowały zgodnie z instrukcjami dotyczącymi polityki określonymi w decyzji nr 40 oraz odpowiednimi wytycznymi dotyczącymi zielonych obligacji, zapewniając finansowanie preferencyjne przedsiębiorstwom należącym do promowanego sektora przemysłu, a zatem działały jako organy publiczne w rozumieniu art. 2 lit. (622) Na podstawie powyższego Komisja uznała, że istnieje szereg dowodów potwierdzających, zgodnie z którymi znaczna część inwestorów inwestujących w obligacje korporacyjne wyemitowane przez przedsiębiorstwa objęte próbą to instytucje finansowe, które mają prawny obowiązek udzielania wsparcia kredytowego producentom BEV. Ze względu na brak współpracy ze strony SAIC i rządu ChRL Komisja musiała oprzeć swoje ustalenia na dostępnym stanie faktycznym zgodnie z art. 28 rozporządzenia podstawowego. Fundusz koncentruje się na strategii krajowej i budowie nowoczesnych klastrów przemysłowych w prowincji Hubei, rozwija się wokół strategicznych wschodzących gałęzi przemysłu, takich jak (między innymi) nowe energie i inteligentne pojazdy podłączone do sieci, co wyraźnie świadczy o związku między zarządzaniem funduszem a realizacją dużych projektów przemysłowych rządu ChRL w prowincji Hubei.

W związku z tym Komisja uznała, że przedsiębiorstwa objęte dochodzeniem odniosły korzyść z finansowania w formie akceptów bankowych, za które nie poniosły żadnych kosztów. (553) Wykorzystanie akceptów bankowych jako alternatywy dla pożyczek krótkoterminowych ilustruje ustalenie przez Komisję, że niektóre przedsiębiorstwa objęte próbą niemal nie zaciągnęły żadnych pożyczek. Do celów obliczeń Komisja uwzględniła jednak linie kredytowe, które zostały otwarte lub odnowione przed okresem objętym dochodzeniem, lecz które były dostępne dla grup objętych próbą w okresie objętym dochodzeniem, a także linie kredytowe, które zostały otwarte w okresie objętym dochodzeniem. (535) Komisja uznała, że ponieważ linie kredytowe są nierozerwalnie związane ze wszystkimi rodzajami finansowania krótkoterminowego udzielanego przedsiębiorstwom objętym próbą, należy je uznać za formę preferencyjnego wsparcia finansowego udzielanego przez instytucje finansowe promowanym sektorom przemysłu, takim jak sektor BEV. W związku z tym badanym grupom przedsiębiorstw przyznano korzyść w rozumieniu art. 6 lit.

Oprócz bezwzględnej wielkości wywozu do Unii Komisja rozważyła ponadto sprzedaż modeli BEV w różnych “segmentach rynku” (rozpatrywanych pod względem różnych “rodzajów produktu”), aby odpowiednio zapewnić największą reprezentatywność przemysłu wytwarzającego produkt objęty dochodzeniem. (42) Rząd ChRL i CCCME stwierdzili, że zgodnie z artykułem prasowym portalu MLex niemieccy producenci BEV, tacy jak Volkswagen, BMW i Mercedes-Benz, nie zostali objęci próbą. CCCME stwierdziła również, że żaden z producentów unijnych nie uzasadnił istnienia “wyjątkowych okoliczności” w żadnym kontekście i nie sporządził pełnych informacji. (36) Komisja uwzględniła ponadto szeroki zakres modeli BEV, aby zapewnić duży poziom reprezentatywności podczas ich porównywania z odpowiednimi modelami wywożonymi przez chińskich producentów eksportujących, zgodnie z przysługującym jej zakresem swobody podczas doboru ostatecznej próby. Podobnie jak w innych dochodzeniach antysubsydyjnych, rozmieszczenie geograficzne rozważono w celu potwierdzenia reprezentatywnego charakteru próby zgodnie z art. 27 rozporządzenia podstawowego. Komisja uznała ten udział za reprezentatywny zgodnie z art. 27 rozporządzenia podstawowego.

Chiny zmieniają kurs – koniec wojny cenowej?

W istocie spośród dziewięciu dostawców LFP do grupy BYD Komisja ustaliła, że co najmniej dwóch z nich było członkami CBIA, a także częściowo własnością państwa. W związku z tym Komisja stwierdziła, że chiński rynek LFP był zdominowany przez dostawców krajowych. Oznacza to, że świat jest zależny od Chin w zakresie rafinacji litu, a dominująca pozycja Chin na tym rynku pozwala im na ustalanie cen na arenie międzynarodowej. (868) Wszystko to dowodzi, że rząd ChRL wprowadził na szczeblu centralnym i lokalnym szereg polityk i środków ukierunkowanych na dostawców materiałów wsadowych, mających docelowo wspierać przemysł BEV. (motyw 750), kiedy to rząd zobowiązał się do sprowadzenia cen surowców wykorzystywanych w NEV (w tym litu) z powrotem do rozsądnego poziomu. Generalnie, rząd ChRL stworzył system, dzięki któremu może sprawować pełną kontrolę nad surowcami mineralnymi.

(693) W toku dochodzenia Komisja ustaliła w szczególności, że jedyna pionowo zintegrowana grupa zaopatrywała się w LFP na potrzeby produkcji akumulatorów BEV u powiązanych i niepowiązanych dostawców. Biorąc pod uwagę znaczenie LFP w procesie produkcji akumulatorów (około 25-35 % kosztów produkcji akumulatora), Komisja skoncentrowała swoje dochodzenie na etapie tymczasowym na kwestii dostarczania LFP za kwotę niższą od odpowiedniego wynagrodzenia. Komisja zebrała informacje od grupy BYD na temat surowców wykorzystywanych do produkcji ogniw do zestawów akumulatorów (tj. taśmy aluminiowej, folii aluminiowej, folii miedzianej, grafitu i LFP).

Chiny: Seks w wielkim mieście

Zamiast działać jako podmioty wolnego rynku dostawcy materiałów wsadowych pełnią przypisaną im funkcję rządową polegającą na rozwoju przemysłu BEV. Główną zasadą stowarzyszenia jest również wspieranie rządu w zarządzaniu gospodarką prywatną i służenie jej (art. 3). Potwierdza to art. 12 statutu CATL, który stanowi, że przedsiębiorstwo “zakłada organizację Partii Komunistycznej i prowadzi działalność partyjną zgodnie z postanowieniami konstytucji Komunistycznej Partii Chin. Przedsiębiorstwo zapewnia warunki niezbędne do prowadzenia działalności przez organizację partyjną” 345 . Potwierdza to, że KPCh wywiera wpływ na wszystkie rodzaje przedsiębiorstw w Chinach oraz że może wykorzystywać jednostki robocze służące rozbudowywaniu partii w przedsiębiorstwach, aby wywierać swój wpływ. W rzeczywistości członkowie KPCh w CATL uważają, że ich “prace związane z Chiny daza do produkcji Made in China i wplyw na ceny miedzi rozbudową partii mają również wyznaczać kierunek rozwoju przedsiębiorstwa” 343 . Dowody świadczące o tak szeroko zakrojonej kontroli znajdują się między innymi w art. 11 konstytucji, zgodnie z którym rząd wyraźnie sprawuje nadzór i kontrolę również nad niepublicznymi sektorami gospodarki (zob. w szczególności motyw 199).

(375) Po pierwsze, grupa Geely argumentowała, że nie można żądać od niej przedstawienia poufnych informacji od niepowiązanego dostawcy, któremu nie może wydawać poleceń, a w każdym razie Komisja otrzymała stosowne informacje. Grupa Geely przedstawiła uwagi dotyczące zamiaru Komisji zastosowania dostępnych faktów w odniesieniu do informacji, o których mowa w motywie 372 i w piśmie z dnia 23 kwietnia 2024 r. Ponadto grupa nie dostarczyła informacji na temat praw do użytkowania gruntów należących do spółek holdingowych istotnych dla jednego producenta eksportującego w grupie. 1 rozporządzenia podstawowego w odniesieniu do grupy Geely Poprzez nieprzekazanie takich informacji, które rzekomo nie dotyczyły produktu objętego dochodzeniem, ale były łatwo dostępne dla grupy SAIC, Komisja nie była w stanie ocenić szczególnego aspektu przedmiotowego programu ulg podatkowych.

• (821) Na tej podstawie Komisja stwierdziła, że dostawców akumulatorów uznaje się za organy publiczne w rozumieniu art. 3 ust.
• Chociaż samo słowo „deflacja” wciąż oficjalnie nie pojawia się w rządowych komunikatach, ton ostatnich wypowiedzi najważniejszych polityków sugeruje, że problem ten nie może być już dłużej ignorowany.
• Uczelnie te finansowane były między innymi z budżetu Departamentu Obrony USA, ponieważ amerykańska armia dążyła do umocnienia swojej przewagi technologicznej.
• Rzeczywiście, zgodnie z podstawowym rozporządzeniem anty- subsydyjnym, cła wyrównawcze powinny być nakładane w przypadku, gdy subsydiowany przywóz z państw niebędących członkami Unii Europejskiej wyrządza istotną szkodę lub w obecnym dochodzeniu grozi wyrządzeniem istotnej szkody producentom unijnym.
• W związku z tym Komisja musiała odwołać się do dostępnych faktów.
• (332) Komisja zwróciła uwagę na fakt, że wspomniany powiązany dostawca i grupa SAIC wspólnie prowadziły przedsiębiorstwo w celu opracowywania, produkcji i sprzedaży ogniw, modułów i zestawów akumulatorów, a zatem były prawnie uznanymi partnerami w działalności gospodarczej.

Informacje

Lokalne władze w poszczególnych prowincjach mogą być także bardzo niechętne jakimkolwiek, odgórnym cięciom produkcji, obawiając się gwałtownego wzrostu bezrobocia na swoim terenie. Popyt krajowy w Chinach pozostaje niezwykle słaby, eksport wyraźnie spowalnia, a wiele kluczowych, nowoczesnych sektorów – jak na przykład produkcja samochodów elektrycznych – jest obecnie zdominowanych przez firmy prywatne, co znacząco ogranicza możliwości bezpośredniej ingerencji ze strony państwa. Chociaż samo słowo „deflacja” wciąż oficjalnie nie pojawia się w rządowych komunikatach, ton ostatnich wypowiedzi najważniejszych polityków sugeruje, że problem ten nie może być już dłużej ignorowany. W czerwcu, indeks cen producentów (PPI) spadł o 3,6% w ujęciu rocznym – to jest największy spadek od lipca 2023 roku i bardzo wyraźny sygnał, że sytuacja staje się naprawdę pilna. Po trzech, długich latach nieustannych spadków cen producentów i wyniszczających wojen cenowych w wielu kluczowych dla chińskiej gospodarki branżach, władze w Pekinie zaczynają w końcu wysyłać bardzo wyraźne sygnały, że czas na fundamentalne zmiany.

(747) W tym względzie dowody dotyczące pułapów cenowych wskazują, że dostarczanie tych towarów regulowanych przez rząd ChRL staje się funkcją rządową, która jest następnie wykonywana przez dostawców materiałów wsadowych działających jako organy publiczne. Moduły akumulatorów powinny kosztować mniej niż 2 juany/Wh, a do 2020 r. (744) Rząd ChRL wdrożył szereg środków w celu zapewnienia, aby akumulatory i materiały do ich produkcji były dostarczane przemysłowi BEV po niskich cenach.

(484) W toku dochodzenia Komisja stwierdziła, że niektóre przedsiębiorstwa objęte próbą wyemitowały obligacje konkretnie w celu spłaty zadłużenia, a mianowicie kredytów i pożyczek. (482) Komisja ustaliła, że przedsiębiorstwa we wszystkich trzech grupach objętych próbą korzystały z różnych kredytów i pożyczek krótkoterminowych i długoterminowych w celu finansowania swojej działalności. A) ppkt (iv) tiret pierwsze rozporządzenia podstawowego wszystkim instytucjom finansowym prowadzącym działalność w Chinach pod nadzorem NFRA (w tym prywatnym instytucjom finansowym) zadanie polegające na realizowaniu polityki rządu i udzielaniu kredytów i pożyczek podmiotom z przemysłu BEV po stawkach preferencyjnych 165 .
